Front Street Software LLC, a Wyoming limited liability company ("Front Street Software," "we," "us," or "our"), operates Murmur Messaging (the "Service"). This Privacy Policy explains how we collect, use, disclose, and protect your information when you access or use the Service. By accessing or using the Service, you acknowledge that you have read, understood, and agree to the collection and use of your information as described in this Privacy Policy. If you do not agree with this Privacy Policy, you must immediately cease all use of the Service.

This Privacy Policy is incorporated into and made a part of our Terms of Service. Capitalized terms not defined herein shall have the meanings assigned to them in the Terms of Service.


1. ELIGIBILITY

The Service is intended solely for users who are 18 years of age or older. By using the Service, you represent and warrant that you are at least 18 years old. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that we have collected personal information from a person under 18, we will take steps to delete that information. 2.2 User Messages

When you use the Service to send and receive messages, the contents of those messages are stored in our database. Messages are currently stored as plain text and are not encrypted at rest. We may implement encryption in the future, but we make no guarantee or commitment to do so.

2.3 Non-Personal Information

We use web cookies to maintain session state and support basic functionality of the Service. A cookie is a small data file stored on your device. You may configure your browser to refuse cookies, but doing so may prevent certain features of the Service from functioning properly.


3. PURPOSE OF DATA COLLECTION

(b) To operate and provide the messaging functionality of the Service

(a) Messages sent through the Service are currently stored as plain text in our database and are not encrypted at rest.

(c) Any transmission of information through the Service is at your own risk.

YOU ACKNOWLEDGE AND AGREE THAT: (A) NO DATA TRANSMISSION OVER THE INTERNET AND NO DATA STORAGE SYSTEM CAN BE GUARANTEED TO BE 100% SECURE; (B) MESSAGES SENT THROUGH THE SERVICE ARE STORED AS PLAIN TEXT AND MAY BE ACCESSIBLE IN THE EVENT OF A DATA BREACH; (C) FRONT STREET SOFTWARE LLC SHALL NOT BE LIABLE FOR ANY UNAUTHORIZED ACCESS TO, ALTERATION OF, OR LOSS OR DESTRUCTION OF YOUR DATA, EXCEPT TO THE EXTENT CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT; AND (D) YOU ARE RESPONSIBLE FOR MAINTAINING THE SECURITY OF YOUR ACCOUNT CREDENTIALS AND FOR ANY ACTIVITY THAT OCCURS UNDER YOUR ACCOUNT.


7. YOUR RIGHTS

Depending on your jurisdiction, you may have certain rights regarding your personal information, including the right to access, correct, or delete the personal information we hold about you. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FRONT STREET SOFTWARE LLC, ITS OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS (COLLECTIVELY, THE "COMPANY PARTIES") MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE SECURITY, ACCURACY, OR COMPLETENESS OF YOUR PERSONAL INFORMATION, THE SECURITY OF YOUR MESSAGES, OR THE EFFECTIVENESS OF OUR SECURITY MEASURES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY PARTIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO ANY UNAUTHORIZED ACCESS TO, ALTERATION OF, OR LOSS OR DESTRUCTION OF YOUR PERSONAL INFORMATION OR MESSAGES, REGARDLESS OF THE THEORY OF LIABILITY.


10. INDEMNIFICATION AND HOLD HARMLESS

You agree to indemnify, defend, and hold harmless Front Street Software LLC and its officers, directors, members, managers, employees, agents, affiliates, successors, and assigns (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, suits, proceedings, losses, liabilities, damages, judgments, costs, and expenses (including but not limited to reasonable attorneys' fees and court costs) arising out of or relating to: (a) your violation of this Privacy Policy; (b) any misrepresentation you make regarding the information you provide to us; (c) any third-party claims arising from your failure to maintain the security of your account credentials; or (d) your violation of any applicable data protection or privacy law.

This indemnification obligation shall survive the termination or expiration of this Privacy Policy, the Terms of Service, and your use of the Service. We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.


11. GOVERNING LAW

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law principles. Any disputes arising under this Privacy Policy shall be subject to the dispute resolution provisions set forth in our Terms of Service, including the binding arbitration and class action waiver provisions.


12. CHANGES TO THIS PRIVACY POLICY

We reserve the right to update or modify this Privacy Policy at any time. When we make material changes, we will notify registered users by email and update the "Last updated" date at the top of this Privacy Policy. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Privacy Policy. If you do not agree, you must stop using the Service and delete your account.
